These Terms and Conditions govern your use of this website.
By accessing or using this website, you agree to these Terms and Conditions. If you do not agree with them, please do not use the website.
2. About Havenbridge Property Group
Havenbridge Property Group works with property owners and accommodation organisations to identify, secure and supply suitable residential properties.
Our activities may include entering into company lease arrangements with property owners, with the appropriate contractual permission for Havenbridge to use or sublet a property for an agreed purpose.
We may also work with housing, accommodation and other organisations seeking suitable residential property.
The precise nature of any arrangement will depend upon the property, its intended use, the parties involved and the terms of the relevant written agreements.
Nothing on this website should be interpreted as confirmation that Havenbridge acts as a letting agent, property managing agent, housing association, local authority or regulated social housing provider in any particular transaction.
3. Purpose of this website
This website provides general information about Havenbridge, our business activities, the types of properties we may consider and opportunities for property owners and accommodation organisations to contact us.
The information on the website is provided for general information only.
Use of this website, submitting an enquiry or discussing a property with us does not create:
- a tenancy or lease;
- a property management agreement;
- an agency relationship;
- a landlord and tenant relationship;
- a guaranteed-rent agreement;
- an agreement to take or supply a property;
- a partnership or joint venture;
- a supplier relationship; or
- any other legally binding property arrangement.
Any such arrangement will only arise when the relevant parties enter into an appropriate written agreement.
4. Property owner enquiries
Submitting details of a property to Havenbridge does not oblige us to accept, lease, manage or otherwise use that property.
Before entering into an agreement, Havenbridge may carry out appropriate checks relating to the property and proposed arrangement.
Depending on the circumstances, these may include consideration of matters such as:
- ownership and authority to let;
- mortgage or lender requirements;
- superior lease or freeholder restrictions;
- insurance;
- property condition;
- gas and electrical safety;
- energy performance;
- fire and alarm requirements;
- planning requirements;
- HMO, selective or additional licensing;
- proposed occupancy;
- location;
- suitability for the intended accommodation use; and
- requirements imposed by an accommodation provider or other contracting organisation.
Havenbridge may decide not to proceed with a property at any stage before a binding written agreement has been entered into.
5. Permission for proposed property use
Where Havenbridge proposes to lease a property from a property owner, the intended use of the property and any right to sublet, licence, provide or otherwise make the property available to another organisation or occupier must be addressed in the relevant written agreement.
Property owners are responsible for ensuring that they have the necessary legal authority and any permissions required to enter into the proposed arrangement.
This may include obtaining consent from a mortgage lender, superior landlord, freeholder, insurer or other relevant party where such consent is required.
Information on this website should not be treated as confirmation that a particular property or proposed use complies with these requirements.
6. Accommodation providers and other organisations
Information concerning properties, locations or potential availability on this website does not constitute a binding offer to supply accommodation.
Property requirements and availability can change.
Any agreement between Havenbridge and a council, housing organisation, accommodation provider, contractor, corporate organisation or other party will be subject to separate written terms agreed between the relevant parties.
7. Property availability
Any statement concerning property availability is subject to change and may be withdrawn without notice before a binding agreement is entered into.
We do not guarantee that:
- a particular property will remain available;
- we will be able to source a property in a particular location;
- a property will satisfy the requirements of a particular accommodation provider;
- a proposed property will obtain any licence, consent or approval required; or
- an enquiry will result in a completed transaction.
8. Geographic coverage
References on this website to areas in which Havenbridge operates, sources properties or considers opportunities are indicative only.
They do not represent a guarantee that we currently have properties, accommodation-provider demand, contracts or availability in every location shown.
We may consider opportunities outside our stated priority areas where appropriate.
9. No guaranteed income unless agreed in writing
Any general references on this website to predictable income, fixed rent, longer-term arrangements, reduced void periods or similar potential benefits describe features that may be available under particular arrangements.
They do not constitute a guarantee that any particular property owner will receive a specified rent, income, lease length, occupancy level or financial return.
The rent, payment arrangements, duration, responsibilities and other terms applicable to a particular property will be set out in the relevant written agreement.
No financial commitment is made by Havenbridge until a binding agreement has been entered into.
10. No professional advice
Information on this website is provided for general information purposes only.
Nothing on this website constitutes legal, financial, tax, mortgage, insurance, planning, licensing or investment advice.
Property owners and other parties should obtain their own independent professional advice where appropriate before entering into a property transaction or contractual arrangement.
11. Accuracy of website information
We take reasonable care to keep information on this website accurate and up to date.
However, property requirements, legislation, regulations, guidance, pricing, availability and third-party requirements may change.
We therefore do not guarantee that every piece of information on the website will always be complete, current or suitable for a particular situation.
Where specific information is important to a proposed transaction, it should be confirmed with Havenbridge and, where appropriate, an independent professional before reliance is placed upon it.
12. Information you provide to us
If you submit an enquiry or provide information through the website, you agree that, to the best of your knowledge, the information you provide is accurate and not misleading.
You should not knowingly:
- provide false property details;
- claim authority over a property that you do not have;
- impersonate another person or organisation;
- submit unlawful, defamatory or fraudulent material;
- upload malicious software or harmful content; or
- use our website or contact facilities for unlawful purposes.
You should inform us if material information supplied in connection with an active property enquiry changes.
13. Personal information
When you contact us, submit an enquiry or otherwise provide personal information, we will process that information in accordance with our Privacy Notice.
Our Privacy Notice explains, among other things:
- what personal information we collect;
- why we use it;
- the lawful basis on which we process it;
- who we may share it with;
- how long we retain it;
- your data protection rights; and
- how you can contact us about your personal information.
Our Privacy Notice should be read separately from these Website Terms and Conditions.
14. Cookies
This website may use cookies and similar technologies.
Where required, information about the cookies used and the choices available to website visitors will be provided through our Cookie Policy and/or cookie consent controls.
Non-essential cookies will only be used in accordance with applicable data protection and electronic communications requirements.
15. Intellectual property
Unless otherwise stated, the content of this website, including its text, branding, logos, graphics, layout and original materials, belongs to Havenbridge Property Group Ltd or is used with the appropriate permission.
You may view and print reasonable extracts from the website for your own personal or legitimate business use.
You must not, without our prior written permission:
- reproduce substantial parts of the website;
- republish our content as your own;
- use our branding or logo;
- commercially exploit our website content; or
- misrepresent an association with Havenbridge.
Nothing in these Terms transfers any intellectual property rights to a website user.
16. Links to third-party websites
This website may contain links to websites operated by third parties.
These links may be provided for information or convenience only.
Unless expressly stated otherwise, Havenbridge does not control those websites and is not responsible for their content, availability, security, privacy practices or services.
A link to another organisation does not by itself mean that Havenbridge endorses, represents or is formally partnered with that organisation.
17. References to partner organisations
Where Havenbridge refers to housing providers, accommodation providers, councils, contractors or other organisations, such references must not be interpreted as evidence of a partnership, contract, endorsement or formal association unless we expressly state that such a relationship exists.
Logos, trademarks and names belonging to third parties remain the property of their respective owners.
18. Acceptable use
You must not use this website:
- unlawfully or fraudulently;
- in a way that infringes another person's rights;
- to introduce viruses, malware or harmful material;
- to attempt to gain unauthorised access to the website, server or associated systems;
- to interfere with the website's operation or security; or
- to collect information from the website through automated means where doing so is unlawful or places an unreasonable burden on our systems.
We may restrict access to the website where we reasonably believe it is being misused.
19. Website availability
We aim to keep the website available but cannot guarantee uninterrupted access.
We may suspend, withdraw, update or change all or part of the website where reasonably necessary, including for maintenance, security, technical or business reasons.
20. Our liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
For users accessing this website for business purposes, Havenbridge will not be responsible for indirect or consequential losses arising solely from use of, or inability to use, the website where such exclusion is permitted by law.
We are not responsible for losses caused solely by reasonable reliance on general website information where the relevant information should reasonably have been confirmed as part of a proposed property transaction.
Nothing in these Terms affects any legal rights that cannot lawfully be excluded or restricted.
21. Separate contracts take priority
These Website Terms and Conditions relate to the use of this website.
They do not replace the terms of any:
- company lease;
- commercial lease;
- tenancy;
- licence;
- property supply agreement;
- accommodation agreement;
- property sourcing agreement;
- referral or introduction agreement;
- service agreement; or
- other contract entered into with Havenbridge.
Where a separate written agreement has been entered into, that agreement will govern the relevant transaction.
If there is any inconsistency between these Website Terms and a separately executed agreement concerning a property or service, the separately executed agreement will take priority in relation to that transaction.
22. Changes to these Terms
We may update these Terms from time to time to reflect changes to our website, business activities, legislation or regulatory requirements.
The latest version will be published on this page together with the date on which it was last updated.
Changes will apply from the date the revised Terms are published and will not retrospectively alter a separately executed contract.
23. Third-party rights
Unless expressly stated otherwise, a person who is not a party to these Website Terms does not have a right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
24. If part of these Terms is invalid
If a court or other competent authority decides that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
25. Governing law
These Website Terms and any non-contractual dispute arising in connection with them are governed by the laws of England and Wales.
If you use this website in the course of a business, the courts of England and Wales will have jurisdiction in relation to disputes concerning these Website Terms.
If you are acting as a consumer, nothing in these Terms removes any rights you may have to bring proceedings in another court where applicable law permits you to do so.
